The MiCA Deadline Has Passed (1 July 2026) — Routes Into the EU Crypto Market
MiCA's transitional period ended 1 July 2026 — no extension. Every EU/EEA grandfathering window is closed; serving EU clients needs a full CASP authorisation.
Last updated: 1 July 2026 · Status: transition ended — windows closed
The MiCA transitional period ended 1 July 2026 — with no extension (ESMA confirmed there would be none on 17 April 2026). Every national grandfathering window across the EU/EEA has now closed; providing crypto-asset services to EU clients requires a full CASP authorisation. If you're not yet licensed, there are three honest routes back to the market — read against the market you're actually entering.
Three routes into the EU crypto market
1 · Authorise from scratch
Apply for a full CASP authorisation in an EU/EEA member state. This is the cleanest route when your capital, governance and timeline can carry a fresh application — it sets your home regulator and EU passport for the long term. The right jurisdiction depends on your service class (and Article 67 own-funds tier), substance requirements and how fast the national competent authority is actually moving.
- Confirm whether MiCA applies to your model, and which CASP class, with the MiCA Exposure Checker.
- Compare jurisdictions, capital tiers and indicative cost/timeline with the CASP Jurisdiction Selector & Cost Estimator.
- Country deep-dives: Malta · Cyprus · Netherlands · Luxembourg.
2 · Passport in
If you already hold — or can quickly obtain — a CASP licence in one member state, MiCA's single-market passport lets you notify and serve clients across the EU/EEA without re-licensing in each country. The strategic question is which single home regulator best fits your model, then expand from there. (Where a national MiCA law never arrived — e.g. Poland, whose crypto bill was vetoed — passporting in from another member state is the realistic route.)
- Pick the home regulator with the CASP Jurisdiction Selector & Cost Estimator.
- See who is actually authorised, by country and service, in the EU CASP Licence Tracker.
- Affected by the Polish stalemate? Where Polish firms can license.
3 · Acquire a licensed CASP (M&A)
Buy an already-authorised CASP instead of applying from scratch — typically the fastest route post-deadline, because the licence already exists. The work shifts from a multi-month application to due diligence: confirming the target's authorisation is genuine and current, that its service scope covers what you need, and that its counterparty and ownership data are clean. That diligence is exactly where these deals go wrong.
- Verify a target's licence, service scope and corporate identity against the registers in the Registry Portal — one regulatory profile across GLEIF (LEI), the ESMA CASP register and MiCA white papers, with honest match flags.
- Cross-check the live authorisation in the EU CASP Licence Tracker.
- HELMS scopes the licence and counterparty due diligence, and the post-acquisition finance & compliance integration — book a call.
The market you’re entering
The EU crypto market after the transition is smaller and more concentrated than the pre-MiCA one. As of 8 Oct 2026 — live from our EU CASP Licence Tracker, drawn from ESMA's register — 370 MiCA (CASP) authorisation records sit on the ESMA register across the EU/EEA — 365 unique active firms once duplicate and withdrawn entries are removed, spread across 27 member states, of which 21 are authorised to operate a trading platform (MiCA service b) — concentrated in Germany (100), France (36), Netherlands (28). Against the thousands of firms that operated under national regimes before MiCA, industry and ESMA-linked estimates put a large majority of previously registered firms unlicensed — there is no clean pre-MiCA denominator, so the often-cited ">80%" is a directional sector estimate, not register data. Many exited or wound down rather than authorise in time.
Enforcement is real: France's AMF has warned that operating without a licence can trigger blacklisting and criminal penalties, and some national authorities sanction unlicensed activity directly. Grandfathering never granted an EU passport — only a full MiCA authorisation does.

Poland: Nominal 6-mo declaration, but the implementing law was vetoed (no competent authority); per the KNF, registered VASPs could operate to the 1 July 2026 EU backstop. No domestic CASP licence — passport in / relocate. Where Polish firms can license.
Reference: ESMA's original list left these "to be announced"; confirm current status directly with the NCA / latest ESMA list before acting. In any case, the 1 July 2026 EU backstop has now passed.
Reference: Per-country periods: ESMA, "List of MiCA grandfathering periods (Art. 143(3))" (verified against the ESMA PDF, 16 Jun 2026). Periods run from 30 Dec 2024; cap 1 Jul 2026. Application cut-off to enter grandfathering: generally 8 Oct 2025 (BG 8 Oct 2025, CZ 31 Jul 2025, DK 30 Dec 2024, IT 30 Dec 2025). Some periods were NCA-communicated and may not yet be in national law — re-verify with the NCA.

Quick answers
The MiCA transition ended — can I still operate under grandfathering?
No. The transitional (grandfathering) period ended 1 July 2026 and every national window has closed. Serving EU clients now requires a full CASP authorisation, or passporting in from a CASP licensed in another member state.
What's the fastest route back to the market?
Often acquiring an already-authorised CASP, because the licence already exists — the work is due diligence rather than a fresh multi-month application. Authorising from scratch and passporting in from an existing licence are the other two routes.
Is the 1 July 2026 deadline really final?
Yes — ESMA confirmed on 17 April 2026 that there would be no extension. 1 July 2026 was the hard EU backstop; many national windows had already closed earlier.
